Cannabis delivery services are becoming more and more common as states decide how to handle the plant as legalization sweeps across the country.

Here’s what you need to know on cannabis delivery laws:

It seems hazier now than ever before what the exact legal standing of cannabis delivery in California is in 2022. The Superior Court of California, County of Fresno recently affirmed a state Bureau of Cannabis Control law enabling retail delivery into “any city” in the state, rejecting the appeal of local authorities trying to restrict such deliveries.

But since then, the County of Santa Cruz v. Bureau of Cannabis Control judgment has been misinterpreted and incorrectly analyzed, leaving licensees, consumers, activists, and attorneys in the dark. 

According to the new laws, customers who get cannabis online or through a delivery service must be at least 21 years old. If you’re looking to buy recreational marijuana, you’ll need to be at least 21, but a doctor’s recommendation will allow you to buy medical marijuana at any age.

Additionally, no deliveries will be conducted to addresses at schools, daycares, or youth centers or on any publicly owned property. All delivery personnel must have government-issued identification, a retailer-issued ID badge, and a copy of the retailer’s license on their person at all times.

Deliveries should be performed by a permanent employee of the store in a closed vehicle fitted with a GPS device and proper storage for marijuana products. Drivers may not transport over $5,000 worth of cannabis products at any one time.

In the state of California, the following are the daily purchase limits:

  • For adults, the recommended daily allowances are as follows: no more than one ounce of cannabis in its natural form; less than 8 grams of refined cannabis; no and not over 6 cannabis plants in their immature stages.
  • For medical use, no more than eight ounces of cannabis each day

Cannabis Delivery Services Are Legal in Some States

Cannabis deliveries are now legal in a handful of states, with many more expected to follow suit soon. This means that you might be able to get some weed delivered right to your door. The new law also prohibits any transactions that are completed through the use of an EBT card, SNAP card, or WIC voucher. Even if you have the cash, you cannot use these types of payment methods for cannabis deliveries starting January 1st, 2022.
